Šie Lietošanas noteikumi („Lietošanas noteikumi“) nosaka tīmekļa vietnes nikitina.lv (saukta „Tīmekļa vietne“) un citu Diānas Ņikitinas elektronisko kanālu, kopā saukti - „Pakalpojumi“, izmantošanu.

Lietošanas noteikumi veido saistošu vienošanos par Pakalpojumiem starp Tevi un mani, Diānu Ņikitinu vai SIA "Darling Im Home" (turpmāk „Autors“).

PAKALPOJUMU DARBĪBAS JOMA UN NOTEIKUMU PIEŅEMŠANA

Lūdzu rūpīgi izlasīt šos Lietošanas noteikumus. Instalējot lietojumprogrammu, reģistrējoties kā Pakalpojuma lietotāja vai citādi izmantojot Pakalpojumus, tu apstiprini, ka esi izlasījusi, sapratusi un akceptējusi šos Lietošanas noteikumus.

LIETOTĀJA PIENĀKUMI

Pakalpojumu mērķis ir uzlabot tavu, kā klienta, pieredzi un attīstīt manu servisu, biznesu, nodrošinot ar tīmekļa vietni un lietojumprogrammu.

Tev jāglabā lietotāja vārds un/vai parole konfidenciāli, tos nedrīkst nevienam izpaust.

Tavs pienākums ir regulāri atjaunot paroli, nekavējoties informēt mani, Autoru, ja tev tapis zināms vai tev ir aizdomas, ka tava parole ir nonākusi trešās personas rīcībā.

Piekrītot šiem Lietošanas noteikumiem, tu esi atbildīga par visām darbībām, kas veiktas, izmantojot tavu lietotāja kontu. Tu esi pilnībā atbildīga par visiem veiktajiem darījumiem un citām saistībām, kas veiktas, izmantojot lietojumprogrammu.

Noteiktu pakalpojumu funkcionalitāšu izmantošanai var būt nepieciešams, lai tu būtu sasniegusi 18 gadu vecumu. Pakalpojumu vai to funkcionalitāšu izmantošanai var būt nepieciešama arī atsevišķa reģistrācija vai citi pasākumi. Autoram ir tiesības nepiedāvāt tev Pakalpojumus vai dažas to funkcijas.

INTELEKTUĀLĀ ĪPAŠUMA TIESĪBAS

Pakalpojumi un to saturs ir Autora un iespējamo trešo personu intelektuālā īpašuma tiesības un konfidenciāla informācija. Pakalpojumu un to satura neatļauta kopēšana un koplietošana ir aizliegta, ja vien tā nav īpaši atļauta šajos Lietošanas noteikumos.

Bez iepriekšējas Autora rakstveida piekrišanas tev nav tiesību:

• kopēt vai izmantot Pakalpojumus vai jebkādus materiālus, ko tie satur, citiem mērķiem, nekā tie, kas aprakstīti Lietošanas noteikumos;
• pārdot, izplatīt vai citādi nodot Pakalpojumus vai materiālus, ko tie satur, jebkurai trešai personai;
• izveidot jebkādus atvasinātus darbus no Pakalpojumiem vai materiāliem, ko tie satur;
• izmantot Pakalpojumus vai jebkādus materiālus, ko tie satur, komerciāliem mērķiem;
• vai ļaut trešai pusei veikt jebkuru no iepriekš minētajām darbībām.
• tu piekrīti nekopēt nekādus materiālus vai citus datus tīmekļa vietnē.
• Tu vari lejupielādēt no tīmekļa vietnes vienu materiāla eksemplāru vienā ierīcē personiskai un nekomerciālai lietošanai, ja vien Autors nav devis atsevišķu rakstveida atļauju cita veida lietošanai.

ATBILDĪBAS IEROBEŽOJUMI

Saskaņā ar tiesību aktos noteikto maksimālo apjomu, tīmekļa vietnē ietvertā informācija tiek sniegta „kāda tā ir”, bez jebkāda veida skaidras vai netiešas garantijas, tostarp garantijas attiecībā uz pārdošanu, intelektuālā īpašuma nepārkāpšanu vai piemērotību noteiktam mērķim. Gadījumā, ja vietnē ir saite uz trešās puses lapu, tā ir paredzēta tikai lietotāju ērtībām, un Autors nav atbildīgs par jebkādu šādā tīmekļa lapā ietvertās informācijas saturu vai pareizību.

Ievērojot tiesību aktos noteikto maksimālo apjomu, Autors nekādā gadījumā nav atbildīgs par jebkādiem zaudējumiem, tostarp tādiem zaudējumiem, kas radušies, neierobežojot netiešus, izrietošus vai īpašus zaudējumus, piemēram, ieņēmumu zaudēšanu vai peļņas zaudēšanu, uzņēmējdarbības pārtraukšanu, datu vai informācijas zudumu, kas izriet no vietnes informācijas izmantošanas veidiem vai nespējas izmantot šo informāciju.

Autors neuzņemas atbildību par jebkādiem netiešiem izdevumiem, zaudējumiem vai zudumiem (ieskaitot iegādes vertību), kas rodas, izmantojot Pakalpojumus vai nespēju izmantot Pakalpojumus. Turklāt Autors nav atbildīgs par zaudējumiem, kas rodas nepārvaramas varas vai cita līdzvērtīga un nepamatota notikuma dēļ, kas kavē Tīmekļa vietnes darbību.

Autors negarantē, ka Pakalpojumi ir pieejami vai ir tavā rīcībā bez pārtraukuma, un nav atbildīgs par datu zudumu vai iespējamiem zaudējumiem, kas radušies Pakalpojuma pārtraukumu dēļ. Pakalpojumi un dati, kurus esi saglabājusi Pakalpojumos, var būt nepieejami līdz turpmākam paziņojumam, piemēram, sakarā ar servera uzturēšanas pārtraukumiem, vai arī dati un citi materiāli var tikt iznīcināti vai neatgriezeniski zaudēti neparedzētu iemeslu dēļ.

Autoram ir tiesības slēgt Pakalpojumus vai liegt Pakalpojumu vai tā daļas izmantošanu un neapstiprināt pirkumu vai citas darbības, ko esi veikusi, izmantojot Pakalpojumus, īpaši šādu iemeslu dēļ:

- drošības apsvērumu dēļ;

- ir iemesls uzskatīt, ka Pakalpojumus vai to funkciju izmanto nepamatoti, nelegāli vai krāpnieciski;

- Pakalpojumus vai to funkcija tiek izmantota tādā veidā, kas ir būtiski pretrunā šiem Lietošanas noteikumiem.

Paziņojumi, ko sniegušas trešās personas, neatspoguļo Autora viedokļus vai prognozes. Autoram nav pienākuma pārbaudīt vai atjaunināt analītiķu vai citu trešo personu izdotos aprēķinus, vai citus nākotnē vērstos paziņojumus. Tu arī pilnībā esat atbildīga par visiem datiem, par kuriem esi ziņojusi vai nosūtījusi Pakalpojumiem. Autors patur tiesības jebkurā brīdī dzēst šādus datus.

Pakalpojumi var saturēt arī saites uz trešo pušu tīmekļa vietnēm. Aktivizējot jebkuru no šīm saitēm, tu atstāj Autora sniegtos Pakalpojumus. Autors nekādā ziņā nav atbildīgs par šādu tīmekļa vietņu darbību, šo tīmekļa vietņu apkopoto datu apstrādi, informācijas saturu, pareizību vai precizitāti šajās tīmekļa vietnēs, vai šādu tīmekļa vietņu izmantošanu. Autors nepārrauga šādu vietņu raksturu vai saturu. Turklāt Autors neiesaka tīmekļa vietnes, informāciju par tām vai jebkuras trešās personas produktiem vai pakalpojumiem. Mēs iesakām rūpīgi izlasīt tīmekļa vietņu Lietošanas noteikumus un Privātuma politikas noteikumus.

DAŽĀDI

Autors jebkurā laikā var bez iepriekšējas paziņošanas veikt izmaiņas Pakalpojumos. Autors var arī jebkurā laikā pārtraukt Pakalpojumu sniegšanu un izdzēst Pakalpojumos ietvertos datus, iepriekš par to nebrīdinot. Autors jebkurā laikā var vienpusēji mainīt vai papildināt šos Lietošanas noteikumus, paziņojot par izmaiņām Pakalpojumos vai sazinoties ar tevi, izmantojot citus līdzekļus.

Izmaiņas stājas spēkā, kad par izmaiņām ir paziņots Pakalpojumos vai kad ir nosūtīts paziņojums, izmantojot citus līdzekļus. Turpinot izmantot Pakalpojumus pēc šāda paziņojuma, tiek akceptēti mainītie Lietošanas noteikumi. Ja tu nevēlies pieņemt izmaiņas, diemžēl pēc izmaiņām vairs nevarēsi izmantot mūsu Pakalpojumus.

Ja vienu vai vairākus Lietošanas noteikumu nosacījumus uzskata par nederīgiem, nelikumīgiem, spēkā neesošiem vai neizpildāmiem, pārējos nosacījumus pēc iespējas precīzāk interpretē saskaņā ar piemērojamiem tiesību aktiem, kas atbilst šo noteikumu sākotnējam mērķim. Citos aspektos noteikumi paliek spēkā pilnībā. Ar nosacījumu, ka Autors neizmantos nevienu no tiesību punktiem saskaņā ar šiem Lietošanas noteikumiem vai atsakās no iespējām izmantot tiesības, pamatojoties uz šiem noteikumiem, tas neierobežo Autora iespējas vēlāk izmantot šīs vai citas tiesības saskaņā ar šiem Lietošanas noteikumiem.

Pakalpojumu sadaļā izmantojam trešo pušu izstrādāto koda programmatūru, kuras izstrādātājs saņem tavus datus un apstrādā tos saskaņā ar savu privātuma politiku un lietošanas noteikumiem. Šos Lietošanas noteikumus reglamentē un interpretē atbilstoši Latvijas tiesību aktiem. Es centīšos atrisināt jebkuras iespējamās nesaskaņas tiešā saziņā ar tevi.

These Terms of Use ("Terms") govern the use of the website nikitina.lv (referred to as the "Website") and other electronic channels of Diāna Ņikitina, collectively referred to as the "Services."
